BackgroundPatients with chronic conditions are less physically active than the general population despite knowledge of positive effects on physical and mental health. There is a variety of reasons preventing people with disabilities from achieving levels of physical activities resulting in health benefits. However, less is known about potential facilitators and barriers for physical activity in people with severe movement impairments. The aim of this study was to identify obstacles and facilitators of PA in individuals with severe disabilities.Materials and methodsUsing a (...) qualitative approach to explore individuals’ subjective perspectives in depth, five community-dwelling adults living with chronic mobility impairments after stroke that restrict independent PA were interviewed. A semi structured topic guide based on the theoretical domains framework was utilized. The interview data was analyzed thematically, and the theoretical domains framework constructs were mapped onto the main and sub-categories.ResultsThe six main categories of facilitators and barriers along the capability, opportunity, motivation–behavior framework were: physical capabilities, psychological capabilities, motivation reflective, motivation automatic, opportunity physical, and opportunity social. The physical capabilities to independently perform PA were variable between participants but were not necessarily perceived as a barrier. Participants were highly motivated to maintain and/or increase their abilities to master their everyday lives as independently as possible. It became clear that a lack of physical opportunities, such as having access to adequate training facilities can present a barrier. Social opportunities in the form of social support, social norms, or comparisons with others can act as both facilitators and barriers.ConclusionWhile confirming known barriers and facilitators that impact the ability of individuals with functional limitations to be active, the findings highlight the need and opportunities for comprehensive service models based on interdisciplinary collaborations. Background: Breaches of publication ethics such as plagiarism, data fabrication and redundant publication are recognised as forms of research misconduct that can undermine the scientific literature. We surveyed journal editors to determine their views about a range of publication ethics issues. Methods: Questionnaire sent to 524 editors-in-chief of Wiley-Blackwell science journals asking about the severity and frequency of 16 ethical issues at their journals, their confidence in handling such issues, and their awareness and use of guidelines. Results: Responses were obtained (...) from 231 editors (44%), of whom 48% edited healthcare journals. The general level of concern about the 16 issues was low, with mean severity scores of <1 (on a scale of 0–3) for all but one. The issue of greatest concern (mean score 1.19) was redundant publication. Most editors felt confident in handling the issues, with <15% feeling “not at all confident” for all but one of the issues (gift authorship, 22% not confident). Most editors believed such problems occurred less than once a year and >20% of the editors stated that 12 of the 16 items never occurred at their journal. However, 13%–47% did not know the frequency of the problems. Awareness and use of guidelines was generally low. Most editors were unaware of all except other journals’ instructions. Conclusions: Most editors of science journals seem not very concerned about publication ethics and believe that misconduct occurs only rarely in their journals. Many editors are unfamiliar with available guidelines but would welcome more guidance or training. (shrink)

Investigating the causes of unethical behaviors in academia, such as scientific misconduct, has become a highly important research subject. The current performance measurement practices (e.g., equating research performance with the number of publications in top-tier journals) are frequently referred to as being responsible for scientists’ unethical behaviors. We conducted qualitative semi-structured interviews with different stakeholders of the higher education system (e.g., professors and policy makers; N = 43) to analyze the influence of performance measurement on scientists’ behavior. We followed a (...) three-step coding procedure and found (1) that the participants described a variety of positive behavioral consequences (e.g., higher productivity) but mainly negative behavioral consequences (e.g., questionable publishing practices) of current performance measurement practices in academia; (2) that scientists’ behavior can be described as gaming performance measurement (i.e., achieving performance goals by reducing performance quality and focusing on those tasks that are measured); and (3) that gaming performance measurement shares the same characteristics as deviant workplace behavior (i.e., a voluntary violation of organizational norms that harms the university). We discuss that gaming performance measurement has not been considered as a type of deviant workplace behavior in the previous literature. Furthermore, we draw from research on deviant workplace behavior and goal setting to discuss psychological processes that may underlie gaming performance measurement. Our results indicate the importance of connecting literature on deviant workplace behavior and goal setting to advance our understanding of gaming performance measurement. (shrink)

Aulis Aarnio addresses the question of how legal interpretations should be justified. Aarnio considers a justification to be rational only if the justification process has been conducted in a rational way, and if the final result of this process is acceptable to the legal community. According to Aarnio, a theory concerning the justification of legal interpretations should contain a procedural component specifying the conditions of rationality for legal discussions, and a substantial component specifying the material conditions of acceptability for the (...) final result. The procedural component of Aarnio’s theory formulates rules for the rationality of legal discussions. The substantial component specifies when the result of a legal interpretation can be called acceptable. Aarnio considers such a result acceptable if it is acceptable to a particular legal community in which there is consensus with respect to certain norms and values. (shrink)

In this essay, some approaches towards the interpretation of language in the early thought of Heidegger are discussed, especially in Being and Time. Heidegger’s language can be understood by pointing out that he saw life as the main interest of philosophy, and questioned philosophy with regard to how it can determine itself. In contrast to Heidegger’s later writings, language is not the primary issue of discussion in the earlier period of his thinking. Therefore, different approaches to language need to be (...) taken. Language can be understood by following the existential analysis of Dasein , namely the interpretation of Rede . Further, the interpretations of Heidegger on Aristotle need to be discussed. As the Greeks had no word for language, the misleading interpretations of logos, dominating the history of philosophy, had an influence on the theory of language. Finally, taking account of prudence as a way to discover beings, another view on language can be found. In this approach to an understanding of language in the early thought of Heidegger, the manner of thinking about language is different to later approaches through poetry. There are traces of thinking about language in Being and Time and Heidegger’s earlier lectures. However, first of all, they have to be found. (shrink)

In this paper I will present Arendt’s concept of judging as related to imagination. Her concept of judging is rooted in Kant’s philosophy, yet bears the potential for the political account of the particular. Inserted in the ongoing debate in intercultural philosophy, as of how to take into account particular circumstances, this paper offers an insight into moral judgment as a possible corrective to normative politics. Reflecting on lived politics through moral judgment in particular situations, this paper highlights the importance (...) of imagination and experience for individual decisions. Bearing as a horizon the intercultural debates it refers only to the question as of how particulars can be taken into account in a political intercultural debate. (shrink)

In this paper, I show how a concept of ethics can be derived from Hannah Arendt’s theory of action in The Human Condition , which contains from her call for action. When she looks at the ‘political actor’, as well as at the concept of ‘political situation’, her ethical claim is first of all the need to take initiative, to act. Hence, ‘political situations’ as she defines them are discussed as common responsibilities. But common responsibility is rooted in the in-between (...) of human beings, rather than in individual human nature and is determined by Arendt’s principle of humanity. Therefore, at the centre of an implicit Arendtian ethics stands the world and the in-between of human beings. (shrink)

"In this paper I am arguing for hermeneutic responsibility in political judgment, as it can be attributed to Arendt’s work. Political judgment is reflective judgment relying on representation by imagination and therefore only has exemplary validity. Along the line of Arendt’s Lectures on Kant’s Political Philosophy I point out her argument for a different generality in politics than the generality of concepts. This generality of political judgment always refers back to the particular. Only by this reference to the particular, namely (...) to facts and situations of direct interaction, can the spectator, who undertakes the political judgment, create the public realm where action takes place. However, this task attributed to the spectator also implies the task of reshaping the public realm. These acts of giving an account of and reconsidering all over again facts handed over by narration and testimony imply the hermeneutic responsibility to unceasingly retrieve factual truth which is rooted in direct interaction. In this contribution the prototypical argumentative patterns are discussed in which pragmatic argumentation is used in the context of legal justification in hard cases. First, the function and implementation of pragmatic argumentation in prototypical argumentative patterns in legal justification are addressed. The dialectical function of the different parts of the complex argumentation are explained by characterizing them as argumentative moves that are put forward in reaction to certain forms of critique. Then, on the basis of an exemplary case, the famous (...) Holy Trinity case, the way in which the U.S. Supreme Court uses pragmatic argumentation in this case is discussed by showing how the court instantiates general prototypical argumentative patterns in light of the institutional preconditions of the justification in the context of the specific case. This paper argues that Habermas's conception of the rationality of moral and legal discussions has import for argumentation theorists interested in the rationality of public deliberations in politics and law. I begin with a survey of Haber mas's discourse theory and his criteria of rationality for moral and legal discourse. I then explain why, in his view, the forms of rational discourse in morality and law complement each other. My aim is to show how Habermas's account of this complementary relationship (...) opens up fruitful perspectives for argumentation theory. Specifically, his thought can stimulate research regarding, on the one hand, the ways in which legal procedures provide for presumptively rational resolutions of moral disputes and, on the other hand, the applicability of ideal argumentation-theoretic models to the legal field. I conclude with a proposal for integrating Habermas's ideas in a research program for legal argumentation. (shrink)

The experience of stress is receiving increasing attention in the context of adolescent mental health, which is why a valid and reliable stress assessment instrument is of great importance. For this purpose, an English-language adolescent stress questionnaire was developed, which assesses the subjective stress experience of adolescents in different areas of life. However, the latest long version of the questionnaire with 56 items was found to be too extensive, so a more economical short version ASQ-S with 27 items was developed. (...) The aim of this study was to validate a German and a Greek version of the ASQ-S. In order to investigate the psychometric properties of the German and Greek ASQ-S confirmatory factor analysis, analyses of variance and correlations were applied to sample data from Switzerland, Germany, and Greece. The results yielded only poor to moderate internal reliability across all three countries and the suggested 9-dimensional factor structure could not be confirmed. Instead, a modified 6-factor structure was tested which showed acceptable model fits while demonstrating form invariance across the three countries. Furthermore, the ASQ-S scales correlated positively with depressive symptoms and anxiety and negatively with self-esteem and life satisfaction, all of which supported adequate concurrent validity. The results revealed that the utility of the ASQ-S appears to be limited when translated to other languages and should be used with caution when administered in international contexts. (shrink)

Child poverty is one of the biggest challenges of today, harming millions of children. In this book, it is investigated from a philosophical social justice perspective, primarily in the context of modern welfare states. Based on both normative theory (particularly the capability approach) and empirical evidence, the authors identify the injustices of child poverty, showing how it negatively affects the well-being of children as well as their whole life course. But child poverty is not 'given by nature'. It is avoidable (...) and there is certainly the moral duty to alleviate it. Therefore, Graf and Schweiger develop a normative theory of responsibilities, which clarifies the moral role of different agents in the poor child's environment: the family, the state and many others, that have so far been neglected in philosophical theories. They conclude their book by sketching how their theory can be extended to global child poverty and what it means to show equal respect and concern for every child - no matter where and in which context they were born. Im zweiten Teil geht es um die zentralen Themen seines “Lieblingsbuches”. Im dritten Teil werden einige seiner handschriftlichen Zusätze und Marginalien kurz vorgestellt, (...) die die 2020 erscheinende Kritische Ausgabe der “Soziallehren” erstmals zugänglich macht. Abschließend entfalte ich eine Antwort auf die Frage, warum es sich auch heute noch lohnt, Ernst Troeltsch zu lesen. (shrink)

The development and use of large and dynamic health data repositories designed to support research pose challenges to traditional informed consent models. We used semi-structured interviewing to elicit diverse research stakeholders' views of a model of consent appropriate to participation in initiatives that entail collection, long-term storage, and undetermined future research use of multiple types of health data. We demonstrate that, when considering health data repositories, research stakeholders replace a concept of consent as informed with one in which consent is (...) engaged. In engaged consent, a participant's ongoing relationship with a repository serves as a substitute or adjunct to information exchange at enrollment. We detail research stakeholders' views of the risks of engaged consent and suggest questions for further study about engagement and consent procedures in initiatives that aim to store data for future unspecified research purposes. The European Universities Initiative (EUI), created by the European Commission in 2017, is a recent novel phenomenon within the European Union policy toolkit that explicitly targets the development of transnational cooperation in higher education (HE). To date, the EUI counts 44 European university alliances, involving around 340 HE institutions. In this paper, we argue that the EUI can be seen as a case of a transnational institution building process representing a potentially significant structural reform for European higher education. Anchored in (...) new institutionalism, we explore the regulative, normative, and cultural-cognitive dimensions of the EUI. Methodologically, this study analyzes the perspectives of European policy actors (n = 4), a set of policy documents (n = 13) and the mission statements of the EUI’s partnerships funded before 2022 (n = 41). The results show that the EUI emerges as the ‘next level of cooperation’ in European HE since it aims to transform European cooperation (regulative dimension), to create and diffuse a new model for European HE following a challenge-based approach (normative dimension), and to work as a way to reinforce and institutionalize European and global scripts for European HE (cultural-cognitive dimension). Based on numerous source documents from the publishers’ archives and particularly on the correspondence between the publishers Wilhelm and Gustav Ruprecht, hitherto unknown but now edited and commented on here, the present article explains that Tillich wrote his System of the Sciences (...) primarily for the publisher. It was Emanuel Hirsch who established the connection between them as the publishing house was looking for a new editor for their popular series Wege zur Philosophie (Ways to Philosophy), published since 1911. After Hirsch having brought Tillich into play, Wilhelm Ruprecht could convince the Berlin “Privatdozenten” to become the new editor of the series. As to the series, Tillich unfolded the concept of a comprehensive system design which covered 65 topics, i. e. forthcoming volumes. When the publisher then demanded that Tillich prove his abilities to write comprehensively in common language by providing a sample of a first issue of the series, he began to work on his System der Wissenschaften. Although this text contained all sorts of ideas and concepts, it was certainly not very well suited as an introduction to a series of popular accounts of the central themes and matters of philosophy. In the end, the System was published, although not as a volume of the series as having been announced by the publishing house in 1922, but as a text in its own right. (shrink)

GOTTFRIED SCHWEIGER,GUNTER GRAF | : In this paper, we want to examine the particular vulnerability of children from an ethical perspective. We want to defend three claims: Firstly, we will argue that children’s vulnerability is best understood as a dynamic quality, meaning that as children progress through childhood, their vulnerability also undergoes particular changes. To capture this, we want to discriminate among physical, mental, social, and symbolic vulnerability, which vary according to certain features, such as age, maturity, gender, and (...) race. These different traits are furthermore important in order to understand what we owe children from an ethical perspective. In a nutshell, children have moral claims not to be harmed and to be protected against threats to their well-being and well-becoming, and these claims have to be explicated via the dynamic vulnerability of children. Finally, we will argue that one of the main issues is to balance the protection of children and their autonomy claims, which both enhance and diminish their vulnerability. | : Cet article examine la vulnérabilité particulière des enfants d’un point de vue éthique. Nous défendrons trois thèses. Premièrement, nous soutiendrons que la vulnérabilité des enfants est mieux comprise en tant que qualité dynamique, ce qui signifie que lorsque les enfants progressent durant l’enfance, leur vulnérabilité subit également des changements particuliers. Pour le mettre en relief, nous distinguerons la vulnérabilité physique, mentale, sociale et symbolique, qui varie en fonction de certaines caractéristiques telles que l’âge, la maturité, le sexe et la race. Ces différents traits sont en outre importants pour comprendre ce que nous devons aux enfants d’un point de vue éthique. En un mot, les enfants ont des exigences morales à ne pas être blessés et à être protégés contre les menaces à leur bien-être et à leur bien-devenir, et ces revendications doivent être expliquées par la vulnérabilité dynamique des enfants. Enfin, nous soutiendrons que l’un des principaux enjeux est d’équilibrer la protection des enfants et leurs revendications d’autonomie, qui à la fois renforcent et diminuent leur vulnérabilité. History of science's spatial turn has focused on the horizontal dimension, leaving the role of the vertical mostly unexplored as both a condition and object of scientific knowledge production. This special issue seeks to contribute to a burgeoning discussion on the role of verticality in modern sciences, building upon a wider interdisciplinary debate about the importance of the vertical and the volumetric in the making of modern lifeworlds. In this essay and in the contributions that follow, verticality appears as a (...) condition of knowledge production—a set of movements and mobilities, technical challenges, political negotiations, and bodily hardships—and an object of scientific inquiry, requiring new techniques of mapping and visualisation and generative of new insights into physical processes and temporal change. By foregrounding the vertical, historians of science can gain new insights and tell new stories about how science is done in the field, the observatory, and the laboratory, and about how those sciences have helped build a modern, three-dimensional world. This article discusses the text of seven passages in the etymological books 5–7 of Varro's De lingua Latina, and proposes new conjectures for all of them. The discussions are of direct relevance to the interpretation of fragments and testimonies of lost Latin authors quoted by Varro: the scenic poets Naevius, Pacuvius, Caecilius Statius, Juventius and Atilius, and the grammarian Aurelius Opillus. The starting point for the discussions is the new Oxford edition of Varro's De lingua Latina by Wolfgang de Melo.

Purpose: To show that the idea of non-dualistic thinking is of great value for some of the core problems of media philosophy (which often lacks the radical approach of Josef Mitterer's concept). Method: Non-dualistic philosophy, introduced by Mitterer, has a lot in common with other thinkers' discontent with the traditional way of describing the subject-object relation. Their differences and the impasses of phenomenological, structuralist and psychoanalytic media theory shall be examined to show whether and to what extent non-dualism could do (...) better. Findings: As sociologists and some media-philosophers are already adopting some principles of non-dualism without a real framework, non-dualistic thinking offers a new insight into the way that consent/dissent is manufactured in a world where most descriptions are given in a mediated (i.e., non-interpersonal) form. Implications: If we re-establish the personal freedom of gathering knowledge individually instead of "getting nearer to the truth," the way of looking at the escapist power of media also has to be reinterpreted. The early distinction between Lumiére-like "documentation" (= truth) and Méliès-like "fiction" (= perception open to alternatives) could be another dualism, which should be expurgated by the application of Mitterer's concepts. This book addresses the endangerment of children’s bodies in affluent societies. Bodily integrity is an important part of a child’s physical and mental well-being, but it can also be violated through various threats during childhood; not only affecting physical health but also causing mental damage and leading to distortions in the development of the self. The authors give an account of three areas, which present different serious dangers: (1) body and eating, (2) body and sexuality, and (3) body and violence. (...) Through an in-depth examination of the available theoretical and empirical knowledge, as well as a thorough ethical analysis, the central injustices in the mentioned areas are identified and the agents with responsibilities towards children displayed. Courtesy of Museo Thyssen-Bornemisza, Madrid; ©1999 Artists' Rights Society (ARS), New York.For much of this century, Hispanists have labored in an effort to elevate Miguel de Cervantes Saavedra’s El ingenioso hidalgo don Quijote de la Mancha (1605, 1615) to the coveted status of the “first modern novel.” Today this kind of criticism may strike our postmodern sensibilities as a rather traditional enterprise, the kind more interested in establishing an elite hierarchy of literary tastes than in saying anything new about an author or text. For many, the study of literature is still an aesthetic beauty pageant in which “great books” like Laurence Sterne’s Tristram Shandy (1767) or Marie de la Vergne de La Fayette’s La princesse de Clèves (1678) are paraded across the stage in a contest to seduce the Western intelligentsia. 1 The postmodern student of literature may not have much concern for this age-old territorial contest, but she might be interested to learn that the fallout from Hispanism’s quest for the “first modern novel” has involved so much attention to, indeed complication of, Don Quixote, that the book now resembles more a postmodern text than an early modern one. At the turn of the century, we have been left with what Jorge Luis Borges would recognize as an “aleph”: an infinite ideological labyrinth that reflects and/or cannibalizes all forms, thereby escaping all attempts [End Page 68] to describe it. 2 Whatever we currently mean by “Cervantes” (an author, a collection of texts, an ideological construction, and so forth) carries with it an impressive range of critical responses. Cervantes has been labeled converso (Castro, Canavaggio), Christian humanist (Castro, Bataillon, Forcione, Herrero, Vilanova), disillusioned secularist (Lukács, Cascardi), precapitalist (Johnson), anti-essentialist (Wilson), anti-Eusebian (Presberg), Menippean (Bakhtin), feminist (El Saffar, Rabin, Cruz), sadist (Nabokov), ethnocentric imperialist (Mariscal), medieval (Gorfkle), homophobic (Martín), non-organicist Aristotelian (Read), and either discursively or actually homosexual (Combet, Rossi, Smith, Arrabal). This list is nowhere near complete, but the reader will grasp the robust effects of the plurality of perspectives on Cervantes.Each of these interpretations is valid to varying degrees within various contexts, but at present I am interested in reading Cervantes as the author of a multicultural manifesto on behalf of the Moriscos of Southern Spain. 3 Within the contexts of French Marxist philosopher Louis Althusser and Palestinian postcolonial literary critic Edward Said, materialist, postcolonial, and multicultural critiques of various forms of power and their ideologies can be seen as the fundamental propositions of Cervantes’s Don Quixote. 4 Cervantes’s ultimate orientation may perhaps be inescapably Eurocentric, but his responses to the European experience of the rise and expansion of an ethnocentric militaristic nation state are relatively centrifugal when compared to the attitudes of many of his contemporaries.In surveying some of the antihegemonic details of Cervantes’s novel, I am also interested in dispelling the popular myth of Don Quixote. This paper is an attempt to think through paranoia’s epistemic and affective features, which pervade both the worldview presented in Senecan tragedy and the inner life of many of its protagonists. Drawing upon recent literary-critical work, I argue that paranoia is temporally and epistemically ambivalent: subjects simultaneously attempt to “get ahead” of a looming cataclysm—looking to the future in an attempt to avert disaster—while inevitably “falling behind,” failing to predict or preempt the future in time to protect themselves. Much of (...) Senecan tragedy plays out paranoia’s future-oriented vigilance on the formal level. Foreshadowing, allusions, and meta-literary flourishes serve to render both readers and characters hyperaware of the earth-shattering horrors to come; however, in doing so, they also reveal that this forward-oriented bracing only serves to dredge up negative affect in advance. By contrast, I argue that Seneca’s Phoenissae thematizes in the character of Oedipus not only paranoia’s future-looking vigilance but also its inherent lagging, the failure to know and act in advance. These elements of slowness, stuckness, and delay open a space for stillness, relief, and intimacy, even within a narrative which hurtles toward cataclysm. (shrink)

This essay theorizes how the enforcement of universal norms contributes to the solidification of sovereign rule. It does so by analyzing John Locke’s argument for the founding of the commonwealth as it emerges from his notion of universal crime in the Second Treatise of Government. Previous studies of punishment in the state of nature have not accounted for Locke’s notion of universal crime which pivots on the role of mankind as the subject of natural law. I argue that the dilemmas (...) specific to enforcing the natural law against “trespasses against the whole species” drive the founding of sovereign government. Reconstructing Locke’s argument on private property in light of universal criminality, the essay shows how the introduction of money in the state of nature destabilizes the normative relationship between the self and humanity. Accordingly, the failures of enforcing the natural law require the partitioning of mankind into separate peoples under distinct sovereign governments. This analysis theorizes the creation of sovereign rule as part of the political productivity of Locke’s notion of universal crime and reflects on an explicitly political, rather than normative, theory of “humanity.”. This volume contributes to the ongoing interdisciplinary controversies about the moral, legal and political status of children and childhood. It comprises essays by scholars from different disciplinary backgrounds on diverse theoretical problems and public policy controversies that bear upon different facets of the life of children in contemporary liberal democracies. The book is divided into three major parts that are each organized around a common general theme. The first part (“Children and Childhood: Autonomy, Well-Being and Paternalism”) focusses on key concepts (...) of an ethics of childhood. Part two (“Justice for Children”) contains chapters that are concerned with the topics of justice for children and justice during childhood. The third part (“The Politics of Childhood”) deals with issues that concern the importance of `childhood´ as a historically contingent political category and its relevance for the justification and practical design of political processes and institutions that affect children and families. Both in scholarship on the Weimar Republic and in historical research in general, many conceptions of ‘crisis’ tend to remain vague and difficult to operationalize. These operational defects of the concept of crisis arise inevitably, we argue, from the concept’s constitutive link to human perception on the one hand and from its subsumption of complex interconnections of historical processes within different subsystems on the other. Frequently today, in both ordinary and historiographical usage, this basic openness of the concept of crisis (...) is foreclosed when it is deployed with a solely negative connotation of ‘downfall’ and ‘decline’, or of something being thrown into question or jeopardy. Such uses obscure a way in which a crisis can evoke not only the pessimistic sense of a threat to the old order but also the optimistic scenario of a chance for renewal. A one-sidedly negative understanding of crisis as prelude to calamity, we argue here, is problematic for historical research for two reasons. Firstly, it obscures comprehension of the consciousness of actors in the relevant period who at any particular moment can have had no prior knowledge of the crisis’s outcome. Secondly, it tends to reify the relevant crisis and to occlude its basic character as something narratively constructed in the accounts of both contemporaries and subsequent historiography. (shrink)

A sudden paradigm shift has resulted in governmental measures that greatly impact the scope in which the ethics committees in Germany can perform their task of providing expert opinions for clinical research. The so-called “revaluation” of the Medical Device Law Deutsches Medizinproduktegesetz—MPG) is, in our opinion, not based on sound political and professional judgment. In accordance with the changed regulations, ethics committees are now seen as being sub-organs of the state medical associations or the medical faculties and are therefore official (...) authorities. It follows that the votes of ethics committees are then “sovereign acts” or authoritative measures! However, equality and justice speak against this misleading conclusion and its resulting consequence that an ethics committee’s vote is a sovereign act. This has, in turn, resulted in the public ethics committees obtaining their long-sought goal of having a state-sanctioned monopoly. The private ethics committees are not recognized as being authoritative bodies, nor are they to be seen as such in the future (i.e. such a status has been denied the Freiburg Ethics Commission International (FEKI) in Baden-Württemberg). This political mistake must be corrected, otherwise, conducting clinical research will become increasingly difficult. (shrink)

On 9 August 1994 the German legislature revised the German Drug Law (AMG). Included in the revision is a passage requiring, for the first time, that the sponsors and investigators of clinical studies involving human subjects first obtain the approval of an ethics committee before carrying out such studies. According to the legislation, which takes effect on 17 August 1995, approval is to come from 'an independent ethics committee, set up and administered according to state law [emphasis added]' (1). Although (...) it is clear according to the text that the 16 federal states have been empowered to establish ethics committees within their jurisdictions, this does not mean that the state governments are free to transfer exclusive authority in the matter to their respective medical associations, a step that would effectively abolish Germany's private ethics committees. First, the legislation does not rule out the authorization of private ethics committees. Second, as legal scholars attest, the exclusive control of ethics committees by the medical associations would constitute an illegal monopoly. Third, it is arguable that medical-association ethics committees fail to meet the one prior federal requirement, that of independence. There is a great deal of confusion in Germany today about which kinds of ethics committees (public and/or private) the states will sanction before 17 August 1995. In an attempt to sort things out we present a brief explanation of how ther came to be two kinds of ethics committees in Germany, review the legal battle between the two over the issue of authorization, point out how the German legislature, in passing the recent bill, has missed an opportunity to clarify the issue and, finally suggest why the administration of ethics committees by the medical associations may be incompatible with the requirement that ethics committees be independent. On September 12, 1949, the liberal politician Theodor Heuss, party leader of the „Freie Demokratische Partei“ (FDP), was elected by the Bundesversammlung (Federal Convention) as the first Bundespräsident, i. e. head of state, of the newly founded Bundesrepublik Deutschland. As a young man Heuss had been a close friend and political ally of Friedrich Naumann, the protestant pastor and left wing liberal politician, supported by Ernst Troeltsch. Heuss then working as a political journalist for liberal newspapers and Naumann’s weekly journal (...) Die Hilfe, was an admirer of Troeltsch, and since 1910 they often met in Heidelberg, at Villa Fallenstein, Ziegelhäuser Landstraße 17, where Max and Marianne Weber as well als the Troeltschs lived; Heuss frequently visited Max Weber’s Sunday jour fixe. When in 1915 Troeltsch became a professor at the Philosophical Faculty of Berlin University Heuss regularly kept in contact with him especially through Hans Delbrück’s „Mittwochabend“, a weekly gathering of liberal intellectuals, professors, politicians and journalists discussing political reforms and the ongoing war. Both Troeltsch and Heuss, 19 years younger, demanded the democratization of the Deutsches Reich, and after the end of the war and the revolution of 1918/19 they became members of the newly founded left wing liberal party „Deutsche Demokratische Partei“ (DDP). After Troeltsch’s sudden death on February 1st, 1923, Heuss wrote an obituary, and, together with his wife Elly Heuss-Knapp, attended the funeral service conducted by Adolf von Harnack. Heuss was a member of the „Demokratischer Klub Berlin“, founded in 1919 by liberal politicians, bankers and academics to regularly discuss the political situation of the new democratic state, the Weimar Republic. Unknown until now, seven weeks after Troeltsch’s death the „Demokratische Klub“ invited its members (the club only had male mebers!) to a memorial act for Troeltsch. On this occasion Heuss delivered a speech „Zu Ernst Troeltschs Gedächtnis“ („To the Memory of Ernst Troeltsch“) which is published here for the first time. (shrink)

Prospective memory is required for many aspects of everyday cognition, its breakdown may be as debilitating as impairments in retrospective memory, and yet, the former has received relatively little attention by memory researchers. This article outlines a strategy for changing the fortunes of prospective memory, for guiding new research to shore up the claim that prospective memory is a distinct aspect of cognition, and to obtain evidence for clear performance dissociations between prospective memory and other memory functions. We begin by (...) identifying the unique requirements of prospective memory tasks and by dividing memory's prospective functions into subdomains that are analogous to divisions in retrospective memory (e.g., short- versus long-term memory). We focus on one prospective function, called prospective memory proper; we define this function in the spirit of James (1890) as requiring that we are aware of a plan, of which meanwhile we have not been thinking, with the additional consciousness that we made the plan earlier. We give an operational definition of prospective memory proper and specify how it differs from explicit and implicit retrospective memory and how it might be empirically assessed. (shrink)

Abstract:In many of his works, Seneca puts a philosophical premium on the ability to see through the deceptive appearances of words and things, identifying the hidden truths that underlie these appearances. In this paper, I turn to a passage that casts doubt upon the efficacy of this interpretive method: Seneca's excursus on flattery in the preface to Book 4a of the Natural Questions. Seneca locates in flattery a pleasure that listeners cannot eradicate by exposing its insincerity. By undermining a hermeneutic (...) practice at the heart of many of his therapeutic methods, Seneca draws out, and invites us to dwell within, a contradiction in his system of thought. Furthermore, in his transition from his discussion of flattery to the scientific content of Nat. 4a, Seneca suggests an alternative approach to treacherous pleasures, which locates therapeutic potential not in the ability to look beyond appearances, but in the "surface-level" experiences of distraction and amazement. In retrospect of a century, the philosophical and theological concepts of Franz Rosenzweig’s New Thinking, as developed in the Star of Redemption, are in many aspects a milestone in modernity, reflecting the crisis of the modern Jew and Judaism both historically and politically. The notion of redemption serves here in fact as a paradigm for modernity itself, where the individual attempts to position himself in the tension between religion and secularism, tradition and modernity. This contribution analyses Rosenzweig’s “Jewish journey of (...) redemption”, not only from the perspective of Jewish Messianism, but in the context of modern Jewish thought as a cultural critique (Kulturkritik) in Western tradition, in its philosophical, theological, historical and political aspects.
